These Terms of Use (“Terms”) govern your access to and use of the Flirta website, mobile site, and related services (collectively, the “Service”). By accessing or using Flirta, you agree to be bound by these Terms. Please read them carefully before using the platform.

If you do not agree to any part of these Terms, you must not use the Service.

1. Eligibility

To use Flirta, you must:

  1. Be at least 18 years old.

  2. Have the legal capacity to enter into a binding contract.

  3. Not be prohibited from using online dating services under any applicable laws.

  4. Use the Service for personal and non-commercial purposes only.

Flirta reserves the right to request age verification and suspend or terminate accounts that violate these requirements.

2. Account Registration

To access certain features, you must create an account and provide accurate and complete information. You agree to:

  • Provide truthful, current, and complete information.

  • Keep your login credentials confidential.

  • Accept full responsibility for all activities conducted under your account.

  • Immediately notify Flirta of any unauthorized access.

Flirta may refuse registration or terminate accounts at its sole discretion.

3. User Conduct

By using Flirta, you agree NOT to:

  • Use the Service for illegal, harmful, deceitful, or exploitative purposes.

  • Post false, misleading, or impersonated profiles.

  • Share explicit sexual content, nudity, or pornographic material.

  • Harass, abuse, threaten, or bully other users.

  • Request or send money to other users (scamming or solicitation).

  • Upload malware, spam, bots, scripts, or harmful code.

  • Collect or extract data (“scraping”) without permission.

  • Use the platform for commercial advertising, escorting, or solicitation.

Flirta reserves the right to remove content or ban users who violate these rules.

4. User Content

“User Content” includes photos, profiles, messages, bios, and any information you upload.

By submitting User Content, you:

  • Grant Flirta a non-exclusive, royalty-free, worldwide license to host, display, and distribute your content for the purpose of operating the Service.

  • Represent that you own or have rights to the content you upload.

  • Accept responsibility for your content and the consequences of sharing it.

Flirta may moderate, remove, or block content that violates these Terms.

5. Safety and Interaction with Other Users

Flirta does not conduct criminal background checks or guarantee users’ identity or intentions. You are solely responsible for your interactions with others.

You agree to:

  • Exercise caution when meeting users offline.

  • Never share financial information, passwords, or sensitive personal data.

  • Report suspicious users or activities to Flirta immediately.

Flirta is not responsible for user behavior, harm, or losses suffered from interactions on or off the platform.

6. Privacy

Your use of the Service is also governed by Flirta’s Privacy Policy, which explains how your data is collected, used, and protected.

By using the Service, you consent to the processing of your personal data in accordance with the Kenya Data Protection Act (DPA), 2019.

7. Payments and Premium Services

Flirta may offer optional premium features (“Paid Services”).

  • All fees are displayed clearly before purchase.

  • Payments are non-refundable unless required by Kenyan law.

  • Flirta may modify or discontinue features with or without notice.

  • Failure to pay may result in service interruption or account suspension.

8. Intellectual Property

All content on Flirta (excluding User Content), including logos, trademarks, designs, text, code, and graphics, is the property of Flirta.

You may not:

  • Copy, distribute, modify, or create derivative works.

  • Use Flirta’s trademarks without written permission.

  • Extract or reverse-engineer any part of the platform.

9. Termination of Account

Flirta may suspend or terminate your account at any time for:

  • Violating these Terms.

  • Suspicious or fraudulent activity.

  • Safety concerns.

  • Non-compliance with laws.

  • Extended periods of inactivity.

You may delete your account at any time through your profile settings.

Termination does not entitle you to any refunds.

10. Disclaimers

The Flirta Service is provided on an “AS IS” and “AS AVAILABLE” basis.

Flirta does not guarantee:

  • That the platform will be uninterrupted or error-free.

  • That users’ profiles are accurate or genuine.

  • Successful matches, interactions, relationships, or outcomes.

Flirta disclaims all liability for any loss, damage, or harm arising from:

  • User content or behavior.

  • Offline meetings.

  • Technical issues or outages.

  • Unauthorized access or use of your data.

11. Limitation of Liability

To the maximum extent permitted by Kenyan law, Flirta shall not be liable for:

  • Loss of profits, data, or goodwill.

  • Personal injury or emotional distress.

  • Financial loss from user scams.

  • Any damages arising from use or inability to use the platform.

Total liability will not exceed the amount paid (if any) for the Paid Services.

12. Indemnification

You agree to indemnify and hold harmless Flirta, its employees, officers, agents, and partners from any claims, damages, losses, liabilities, or expenses arising from:

  • Your use of the Service.

  • Your violation of these Terms.

  • Your interactions with other users.

  • Your infringement of intellectual property rights.

13. Third-Party Services

The platform may contain links or integrations to third-party services (e.g., payment processors, social login services). Flirta is not responsible for:

  • Their content, policies, or actions.

  • Any transactions or interactions with third parties.

14. Changes to Terms

Flirta may update these Terms at any time. Updates take effect immediately once posted.

Continued use of the platform means you accept the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Kenya.

Any disputes shall be resolved through:

  3. As a last resort, Kenyan courts.
